Learning Objectives

From a historical perspective , we intend to examine the principles and constitutional rights affected by the complex phenomenology of mass communications . Article . 21 of the Constitution occupies a fundamental role .
It will analyze the press , since the legislation of the unified state through the events of fascism until the evolution of the discipline in the Republic .
They will be treated the events order for radio and television .
The course also offers a reflection on the legal aspects of the profession of journalism , especially in relation to new forms of expression through the Internet .

Program

1. Art. 21 of the Constitution. And freedom of expression in the Italian Constitution: content, limitations, interpretations, the relationship with information.
2. The protection of freedom of expression in the international order: the ECHR, the Charter of Nice, the UN Declaration.
3. Print: Italian legislative framework in the state from its origins to today. Models of press freedom in the unit period. Art. 28 Albertine Statute. Print and fascism. Association of Journalists. The press in the process of formation. Law no. 47 of 1948. The reform of the Order of Journalists. Press offenses. Privacy and Information. The publishing companies. Antitrust and pluralism in the press.
4. Radio: normative discipline from its origins to oggi.Sistema television and state form. The state monopoly in the Italian origins. The reforms of the '70s.
The main judgments of the Constitutional Court on the matter. The mixed system and the first antitrust law. The discipline of the European audiovisual media services. The rules on advertising. Political communication. The public service in Community law and national law. The consolidated broadcasting.
4. Shows and theater: normative discipline from its origins to today. Attempts at censorship and authorizations between stage liberal fascism. Measures to support enterprises. The film law. Administrative structures for the shows.
5.Il information pluralism cardinal principle of the Italian and European communications massa.Democrazia, public opinion and truth. The European roots of freedom of expression.

Learning Achievements (Dublin Descriptors)

1.The student will be able to analyze the main legal institutions treated showing sufficient knowledge about the rules and their evolution .
2.The skills to be acquired thus relate to the maturation of a critical point of view and independent to the legal principles in the field of information and communication through the major media .
3.Il course aims to equip the student basic concepts that can enable one to deal with the rules of the new forms of expression through the Internet .
4. Powers relating to prove knowledge of the Italian and European legislation on freedom of expression through the media . Even more significant jurisprudential interior ( Constitutional Court , Supreme Court ) will have to be mastered .

Assessment

The exam will be held through an individual interview based on textbooks suggested. The aim is to evaluate both student's comprehension of the content and his ability in reworking concepts and in argumenting. It is possibile to present a written document on a topic agreed with the teacher. 

Excellent grades will be given in presence of: a good critical perspective and in depth study; knowing how to link among them the main subjects addressed during the course; the use of an appropriate language.

Good grades will be given in presence of:  good mnemonic knowledge of the contents; a relatively good critical perspective and connection skills related to the treated topics; the use of appropriate language.

Sufficient grades will be given in presence of: the achievement of a minimal knowledge on the treated themes, even in presence of some gaps; the use of a not appropriate language.

Negative grades will be given in presence of: a difficult orientation related to the the treated topics; knowledge gaps; the use of a not appropriate language.

Disabilità e DSA
