Learning Objectives

The course aims to offer a broad knowledge of mediation and legal implications, from its theoretical assumptions within the ADR (Alternative Dispute Resolution) paradigm, focusing on the psychological and communication aspects. The course will also delve into family mediation, as a clinical intervention for the separating couple, addressing the issues relating to this phase of the life cycle, also with exercises on typical cases.

At the end of the course, students will be able to have a broader vision of the mediation tool and its application; the macro-theme relating to the conflict will be explored in depth, trying to discern both its evolutionary and critical aspects.

Students will have to know the main theories underlying the construct of mediation, the techniques used in the field of family mediation and in other contexts of application such as: school, territory, companies, criminal areas.

Program

The course aims to provide students with the opportunity to orient themselves, both on a theoretical and practical level, towards a knowledge of mediation and its application areas. Tools and knowledge will be provided to navigate the broad application context of conflict mediation in both the cultural/social/scholastic and judicial fields.

We will specifically address some issues relating to:

  • conflict, attachment styles in emotional relationships (4 hours);
  • theories and techniques of mediation, separation, dynamics of intergenerational conflicts (4 hours);
  • the phases of mediation (2 hours);
  • family mediation and various forms of conflict mediation: transformative mediation and problem-solving mediation (8 hours);
  • the life cycle and evolutionary processes of the family (4 hours);
  • techniques and strategies for an alternative resolution (4 hours);
  • the difference between family mediation and office technical consultancy (1 hour);
  • linguistic-cultural mediation (3 hours);
  • business and school mediation (3 hours);
  • criminal mediation (3 hours).

Learning Achievements (Dublin Descriptors)

  • Knowledge and understanding. At the end of the course, students must be able to understand and explain the fundamental concepts of mediation (what it is about, how it works, what its theoretical assumptions are)  and in particular what uses mediation can have.
  • Ability to apply knowledge and understanding. At the end of the course, students will have to demonstrate the ability to apply knowledge of mediation techniques, the phases of mediation and its applications.
  • Making judgments. At the end of the course, students will have to demonstrate the ability to use knowledge and concepts to reason with independent judgment according to the logic of the discipline.
  • Communication skills. At the end of the course, students must be able to present and discuss the topics studied with conceptual and linguistic precision, and to outline general frameworks that effectively and concisely illustrate the problems addressed.
  • Learning skills. At the end of the course, students must have achieved a certain familiarity with the basic concepts of mediation and in particular family mediation in order to be able to independently acquire new knowledge by consulting the main bibliographical tools that deal with the discipline.

Disability and DSA

Students who have registered their disability certification or DSA certification at the Inclusion and Right to Study Office can ask to use concept maps (by keywords) during the exam. To this end, it is necessary to send the maps, two weeks before the exam session, to the course teacher, who will verify their consistency with the University guidelines and may request their modification.
