The course is aimed at the knowledge of the following topics:

1) models of environmental protection, with particular reference to the problems connected to the alternative between self-regulation and heterodiscipline;

2) the principles of criminal intervention in environmental matters, with particular reference to knowledge of the community regulatory framework, of the relevant constitutional principles (articles 25, 27, 32 of the Constitution) and the general rules of liability contained in the criminal code;

3) the individual types of offense, with particular reference to those governed by Book II, Title VI bis "Crimes against the environment" of the criminal code and those contained in Legislative Decree no. 152 of 3 April 2006 (limited to the subject of the course program)

The course also aims to provide the essential theoretical and methodological knowledge necessary for the updated knowledge of the application practice and its use for the purpose of understanding the regulatory sources analyzed.

1) The "general part" of environmental criminal law.

2) The offenses governed by the Law no. 152, 3rd april 2006, regarding:

a) waste management;

b) water pollution;

c) atmospheric pollution.

Criminal law first part

The course aims to provide the student with the necessary knowledge to advise him to correctly interpret the reference legislation and to identify the most appropriate solutions to the cases that will be proposed.

The student must therefore demonstrate:

1) institutional knowledge of the reference legislation and mastery of its interpretation techniques (knwoledge and understanding);

2) the mastery of the argumentative framework necessary to support arguments in relation to the interpretative nodes of the matter (applying knowledge)

3) knowledge of the methods of retrieval and overall analysis of relevant information (making judgment);

4) the ability to logically and comprehensively explain the solution to the issues that will be proposed (communication skills);

5) full mastery of learning skills that will allow him to continue studying independently (learning skill)

Assessment

Oral exam. This method makes it possible to fully ascertain the acquisition of the course objectives and to verify the mastery of a correct and relevant language.

The expected learning outcomes will be assessed through the formulation of three or more questions. The evaluation criteria and scores are determined according to the following scale:

less than 18/30 - insufficient level: the candidate does not achieve any of the learning outcomes indicated in the point "knowledge and understanding";
18-20 / 30 - sufficient level: the candidate reaches, in particular, the learning outcomes indicated in the point "knowledge and understanding";
21-23 / 30 - fully sufficient level: the candidate reaches, in particular, the learning outcomes specified in the points "knowledge and understanding" and "applied knowledge and understanding";
24-26 / 30 - good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding" and "independent judgment";
27-29 / 30 - very good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Independent judgment" and "communication skills";
30-30 cum laude - excellent level: the candidate fully achieves the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Autonomy of judgment"; "Communication skills" and "ability to learn".
