Learning Objectives

The course is aimed at getting to know the sources of penitentiary law and the penitentiary system. The course aims to make students acquire, in addition to the skills in penitentiary matters, the ability to interpret and apply the rules of the legal system on the subject as well as to find, understand and use the jurisprudence and the relevant statistical / social data.

Constitutional principles and execution phase of the sentence - Treatment of prisoners - Intramural treatment and rights of prisoners - Elements of treatment - Order and security in prisons: emergency legislation, protection program for collaborators and witnesses of justice - Rehabilitation treatment of prisoners - Progressive treatment - Extramural treatment - Alternative measures: probation, home detention, semi-liberty regime, conditional release Order of execution Surveillance judiciary: structural and regulatory profiles - Functions of the surveillance magistrate - Functions of the surveillance court - Enforcement procedures Penitentiary execution against the minor: general profiles

Learning Achievements (Dublin Descriptors)

A) knowledge and understanding: The student must demonstrate that he has acquired knowledge and understanding of the procedural institutes concerning the execution of sentences following criminal convictions that have become definitive. he will also have to demonstrate a mastery (in-depth knowledge) of the main rules of the penitentiary system in force, of the foundations of penitentiary law and of juvenile penal execution. B) Applying knowledge and understanding: The student will have to demonstrate that he is able to put into practice the knowledge acquired in the solution of concrete cases even within broader or interdisciplinary contexts. C) making judgment: The student must be able to autonomously deepen what he has learned and demonstrate the ability to process complex or fragmentary information in order to arrive at autonomous ideas and judgments including reflection on social and ethical responsibilities deriving from application of its skills. D) communication skills: The student must demonstrate that he is able to communicate his conclusions in a clear, logical and effective way in the occasions of discussion with the teacher, with colleagues or within working groups and seminars . E) ability to learn (learning skills): The student must demonstrate that he has developed the skills necessary to study independently

Assessment

Partial checks: oral or written. The written test consists of very simple questions useful for selecting students capable of taking the oral exam, which is considered the only one suitable for verifying communication skills and possession of the necessary knowledge of the subject. Final exam: oral interview. This method of assessment makes it possible to evaluate in the most complete way, as well as the student's communicative ability, the acquisition of the analytical and critical skills required of the student in consideration of the complexity of the topics and arguments covered by the course of which he must demonstrate knowledge and the comprehension. In the aforementioned discussion, the expected learning outcomes will be assessed by formulating three or more questions. The evaluation criteria and scores are determined according to the following scale: less than 18/30 - insufficient level: the candidate does not achieve any of the learning outcomes indicated in the point "knowledge and understanding"; 18-20 / 30 - sufficient level: the candidate reaches, in particular, the learning outcomes indicated in the point "knowledge and understanding"; 21-23 / 30 - fully sufficient level: the candidate reaches, in particular, the learning outcomes envisaged in the points "knowledge and understanding" and "applied knowledge and understanding"; 24-26 / 30 - good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding" and "independent judgment"; 27-29 / 30 - very good level: the candidate reaches, in particular, the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Autonomy of judgment" and "communication skills"; 30-30 cum laude - excellent level: the candidate fully achieves the learning outcomes indicated in the points "knowledge and understanding"; "Applied knowledge and understanding"; "Autonomy of judgment"; "Communication skills" and "ability to learn".

The exam and the bibliography can be in Spanish at the request of the student.
