Learning Objectives

The second module of the course (in close continuity with the first) aims to deepen the transformations of the Italian economic constitution induced, on the one hand, by the entry into the Economic-Monetary Union established with the Maastricht Treaty and, on the other hand, by the impetuous dynamics of the economic-financial globalization of the last three decades. In particular, the European public finance constraints that are increasingly binding on the holding of the democratic-social state will be analyzed. Particular attention will be devoted to the effectiveness of fundamental social rights, in the framework of a powerful reorganization of supranational economic governance, following the so-called sovereign debt crisis.

1) The economic constitution of Maastricht: monetary policy and fiscal policy

2) The convergence of national fiscal policies

3) The completion of the internal market for services and its repercussions on the internal system

4) Systemic crisis of the monetary union and sovereign debt crisis

5) The responses to the crisis of the European Union: Fiscal compact and the European Stability Mechanism

6) The transformations of the democratic-social state and of the  Regions legal systems

7) The Italian economic constitution in the vortex of financial globalization

8) The transformation of European economic governance and social rights

Learning Achievements (Dublin Descriptors)

Knowledge and understanding. The student must demonstrate adequate knowledge of the course topics indicated in the program; he should demonstrate that he is familiar with the methodology and the main categories of public economic law, both at the level of legal norms and at the level of practice and jurisprudence.

Applied knowledge and understanding. The student must demonstrate that he has the ability to interpret and apply its knowledge in the search for solutions to issues related to public economic law. The student should  interpret and apply the sources of Italian and European law, understand constitutional and community jurisprudence in the field of economic law.

Making judgments. The student must demonstrate the ability to interpret the rules of the constitutional system relating to economic law, integrating the knowledge acquired and evaluating the repercussions of the European integration process from its origins linked to the single market to the introduction of the single currency.

Communication skills. The student must demonstrate that he is able to clearly communicate his knowledge also in the context of the debate on jurisprudential cases that could arise during the lectures or in the thematic in-depth seminars. The student must demonstrate to be able to present the acquired notions with argumentative coherence, logical-systematic rigor and language properties.

Learning skiils. The student must demonstrate that he has developed the ability to understand the complexity of the phenomenon of public economic law, also in view of an autonomous continuation of the study with particular reference to the areas of public law. This also by continuously updating its skills and using the knowledge acquired during the course.

The evaluation criteria and the scale of marks are as follows:

less than 18: competence level insufficient. The student doesn’t reach the learning results described in “knowledge and understanding”;

18-20: competence level sufficient. The student attains the learning results described in “knowledge and understanding”;

21-23: competence level satisfactory. The student attains the learning results described in “knowledge and understanding” and in “applied knowledge and understanding”;

24-26: competence level good. The student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding” and “making judgments”;

27-29: competence level very good. The student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “communication skills”;

30-30 with honours: competence level excellent. The student fully attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “learning skills”.

Disabilità e DSA
