Learning Objectives

The course aims to offer students an overall cognitive picture of the institutes, subjects and activities that characterize the complex sporting phenomenon from a legal point of view. The goal is to provide not only theoretical but also operational and managerial knowledge of the public and private disciplines of sport. The fundamental notions concerning the sports legal system will be acquired, the subjects who work there with particular regard to competences and responsibilities. The main contracts used in the sports field and the forms used for this purpose by the operators of the sector, both in the field of professional sport and in the field of amateur sport, will be taken into account. Particular insights will concern the discipline of sports facilities and television rights.

Program

The course aims to illustrate the fundamentals of sports law, both from a public and private point of view due to the complex and multidisciplinary nature of the subject. Under the first horizon of analysis, the sports legal system will be taken into account, both in its own connotations and in its correlation with the Italian system within the constitutional framework. The main subjects who operate there will be described, with reference to the skills and activities they carry out within the legal system, including the judicial functions.

Bridging Courses

A student's knowledge of the basic elements of legal language is required. Knowledge of the main institutions of private law and public law is recommended, as well as knowledge of the principles of constitutional law

Learning Achievements (Dublin Descriptors)

A) Knowledge and understanding: the student must demonstrate that he has assimilated the fundamental principles of sports law both in terms of publicity and private law. He must demonstrate that he knows how to distinguish the peculiarities of the sporting discipline, both with reference to the penalties for liability, and the different legal regimes in which sports subjects and bodies operate in the public or private sector.

B) Applying knowledge and understanding: the student must demonstrate that he / she possesses a sufficient mastery of presentation in relation to the various fields of the discipline.

C) Making judgments: the student must demonstrate the ability to synthesize the knowledge acquired, through the integration of relevant data.

D) Communication skills: students must demonstrate that they are able to express their conclusions on specific issues in a sufficiently clear and concise way, also providing solutions to particular questions, also drawn from practical experience.

E) Ability to learn (Learning skills): the student must demonstrate that he has acquired a capacity for learning, and selective data processing, such as to allow him to continue in his studies by applying the ability of synthesis capable of guaranteeing a sufficient level of autonomy.

Supporting Activities

The teaching activity will be integrated by in-depth seminars on specific topics, with particular reference to the legal knowledge of topical topics or particular professional activities.

Assessment

Written test. The expected learning outcomes will be assessed, as mentioned, through an oral exam based on at least three questions. The evaluation criteria and the correlated scores are determined according to the following scale: less than 18/30: insufficient level of competence. The candidate does not achieve any of the learning outcomes provided for in the point "knowledge and understanding"; 18-20 / 30: sufficient competence level. In particular, the candidate achieves the learning outcomes envisaged in the point "knowledge and understanding"; 21-23 / 30: fully sufficient level of competence. In particular, the candidate achieves the learning outcomes envisaged in the points "knowledge and understanding" and "applied knowledge and understanding"; 24-26 / 30: proficiency level: good. Notes

The current didactic regime of the examination envisages the passing of two partial examinations: Sports Law held by the undersigned Prof. Alberto Clini and European Union Law held by Prof. Edoardo Rossi.
There is no propaedeuticity between the two subjects: the student may freely take one or the other exam first or both without any restrictions.
In order to take the examination, the candidate must register in the roll call, taking great care to enter the group he or she belongs to. For organisational reasons there are two groups according to the student's surname: A-K and L-Z.
The Sports Law examination is written with multiple choice questions.
The professor is not allowed to take the exam in the student's place, so in the event of the student's inability to register, the student will not be able to take the exam and will have to register for the next exam.
The grade obtained in one of the two examinations is not subject to a deadline: what matters is that once the partial grade has been accepted, it is entered in the Esse 3 platform.
When the student has obtained both the marks for the two partials, he/she must register for the next available exam in the transcript list indicated as "VERBAL. SPORTS LAW / EU LAW (AK-LZ)". 

The entry on the latter list, which is unique in that it brings together all students (AK-LZ), determines my task of verifying the two individual grades, averaging them and assigning the result as the final grade. Obviously, if one of the two grades is missing from the verification within the Esse 3 platform, I am unable to determine the grade, nor can I act by entering the missing grade on informal indications of any kind. So you will find as a result "Withdrawn" which in this case means that I was unable to assign the final mark due to the absence of one or both marks (according to the indications received from the secretariat). I would point out that I cannot see whether or not you have one or both marks, except for the mark I awarded for Sports Law: you must contact the secretariat or the professor who awarded you the mark for the partial.
For the awarding of the final grade, as the average of the two marks for the two parts, the student's presence is not required.
