Learning Objectives

San Marino legal system is very interesting: this country has preserved the legal system befire coding, and so it has maintened the plurality of sources of law (statute law anche ius commune).

The course aims to approach the student to this special legal system. The study will be followed by the introduction to the principal institutes of private law.

Program

The course is divided in two parts.

PART 1

Introduction oc the study of the sources of law: Constitution, statute law, ius commune and customs. The interprertation and the interaction among the sources.

PART II

Law of contract, property and law civil liability.

Learning Achievements (Dublin Descriptors)

The student wil acquire:

- full knowledge and comprehension of San Marino legal system;

- full knowledge of the main partition of privale law and of the comparative methology;

- capacity of understanding the purposes ad effects of law policies;

- capacity of work out of paper.

The holder of the qualification possesses:

- capacity of applying domestic and San Marino rules and regulations understanding differences and resemblances;

- capacity of finding, also through data bank, undestanding and employing domestic and San Marino statute law, case law and material;

The acquisition of the above indicated requirements is verified through exercises on cases and final exam.

The teaching material prepared by the lecturer in addition to recommended textbooks (such as for instance slides, lecture notes, exercises, bibliography) and communications from the lecturer specific to the course can be found inside the Moodle platform › blended.uniurb.it

Teaching

The course consists in lessons, with the active partecipation of students to discussion on material (cases, statutes, etc.)

At least 30 hours

The student who attended the course prepare the exam on the material indicated during the course.

Assessment

Oral exam.

The expected learning results will be evaluated by means of an oral exam, based on three questions or more. The evaluation criteria and the scale of marks are as follows:

less than 18/30: competence level insufficient. The student doesn’t reach the learning results described in “knowledge and understanding”.

18-20: competence level sufficient. In particular, the student attains the learning results described in “knowledge and understanding”.

21-23: competence level satisfactory. In particular, the student attains the learning results described in “knowledge and understanding” and in “applied knowledge and understanding”.

24-26: competence level good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding” and “making judgments”.

27-29: competence level very good. In particular, the student attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “communication skills”.

30-30 with honours: competence level excellent. The student fully attains the learning results described in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and “learning skills”.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
