Learning Objectives

The course aims to acquire knowledge of the institutions of the general part of criminal law. In this second part, as well as the central phase of the lessons, will be covered all types of crime in corporate, bankruptcy, tax and market abuse.

Program

Given brief notes on the general part of criminal law, the following crimes will be discussed:

a) corporate crimes;

b) bankruptcy crimes;

c) market abuse;

d) tax crimes.

The exam will focus on 3 of the 4 groups of crimes indicated: on corporate crimes (a), on bankruptcy crimes (b) and, at the student's choice, on market abuse (c) or on tax crimes (d).

Learning Achievements (Dublin Descriptors)

The course aims to provide the student with the necessary knowledge to allow him to correctly interpret the reference legislation and to identify the most appropriate solutions to the cases that will be proposed.

The student must therefore demonstrate:

1) institutional knowledge of the reference legislation and mastery of its interpretation techniques (knowoledge and understanding);

2) mastery of the argumentative framework necessary to support arguments in relation to the interpretative nodes of the matter, with particular reference to the use of jurisprudential law (applying knowledge);

3) knowledge of the methods of retrieval and overall analysis of relevant information (making judgment);

4) the ability to expose their basic knowledge and the solutions of the questions that will be proposed to them (communication skills) with logic and completeness, language properties and without ambiguity;

5) full mastery of the learning skills necessary for the continuation of the study independently (learning skill).

Assessment

Oral test in order to verify the necessary mastery of the theoretical concepts and the reasoning ability on the topics covered.

The oral exam allows to evaluate in the most complete way the student's communication skills, the acquisition of the analytical and critical skills required in consideration of the complexity of the topics and arguments covered by the course

The evaluation criteria and the scale of marks are as follows:
• less than 18: competence level insufficient. The student doesn’t reach the learning results described in
“knowledge and understanding”;
• 18-20: competence level sufficient. The student attains the learning results described in “knowledge and
understanding”;
• 21-23: competence level satisfactory. The student attains the learning results described in “knowledge
and understanding” and in “applied knowledge and understanding”;
• 24-26: competence level good. The student attains the learning results described in “knowledge and
understanding”, “applied knowledge and understanding” and “making judgments”;
• 27-29: competence level very good. The student attains the learning results described in “knowledge
and understanding”, “applied knowledge and understanding”, “making judgments” and
“communication skills”;
• 30-30 with honours: competence level excellent. The student fully attains the learning results described
in “knowledge and understanding”, “applied knowledge and understanding”, “making judgments” and
“learning skills”.

Disability and Specific Learning Disorders (SLD)

Students who have registered their disability certification or SLD certification with the Inclusion and Right to Study Office can request to use conceptual maps (for keywords) during exams.

To this end, it is necessary to send the maps, two weeks before the exam date, to the course instructor, who will verify their compliance with the university guidelines and may request modifications.
