Learning Objectives

The topics prented in the course are relevant to both the sociological curriculum, and for that social service, taking into account both general problems of law-society relationship, both with reference to the specific analysis of the evolution of family forms. Specifically, the course has as general objective the acquisition of skills in the field of sociology of law, as it stands in the current framework of the critical study of law, and of the main problems that affect its application and functions. In view of achieving this objective, subjects as rules,  action, institutions,  roles, opinions will be addressed, both in a sociological and a juridical science view.

The course also aims to introduce students to the study of the relations between the family and the law, as they are studied by the sociology of law in the analysis of the legal regulation of family and an evolving socio- economic and changes in life. In this perspective, the analysis will highlight persistence and changes in social phenomena relating to families and legal regulation; Particular attention will be paid to changes in parenting and relationships between parents, legal culture, and expert knowledge. Thus, at the end of the course students will be able to acquire an adequate understanding of the evolution of family and parental relations in recent decades, putting them in relation with the legal regulation of the families.

Program

First part:   Epistemological notes about a border discipline.  Law and society, epistemological premises. Action and promotion ; normative action through  legislation. Methodology of socio-Legal Research. Socio-legal facts in quantitative and qualitative methodology. Research techniques: interviews, focus groups, participant  observation. Laws of man and laws of nature: the environment and information resource

Second part 1.  family transformations and law. The family model in the Constitution. The season of reforms. The interests of the child as the overarching principle. Individualism in family relationships. The expansion of the control to families with children. The couple's relationship: the imperfect parity. Marital conflict and its regulation. Stepfamilies. The centrality of the parent-child relationships. Parenting, Co-Parents, multi parenthood. The adjustment of the families in multicultural societies. Cohabitation.

2.   Parental adequacy: a research path. Adequate parenting and the role of experts. Parenting styles between past and present. The authoritarian perspective. The anti-authoritarian perspective. Permissive practices. Authoritative parenting. The representation of the adequacy of the legal parental culture and culture experts. Proper parenting: the point of view of the operators and the parents' point of view, the culture of parenting and the ideology of the Intensive parenting. Distance and proximity from the expert culture. The quality of the parental relationship. The disciplinary control. Towards an effective and responsible parenthood

Learning Achievements (Dublin Descriptors)

It is expected that students will acquire:
1. knowledge and understanding: mastery of basic knowledge about the current structure of the sociological-epistemological legal framework, with particular reference to its constituent elements (problems and methods) in relation with social and legal sciences
The students will attain these basic knowledge: by participating in lessons and through the analytical study of the texts proposed by the teacher and discussed in the classroom.
2. Applying knowledge and understanding: The student will demonstrate an understanding of the concepts and theories provided by the course; developing new insights, both from a theoretical and empirical point of view.
To be achieved through classroom discussions, interacting with the teacher, reading texts.
3. Capacity of judgment: critical reflection on themes, topics, texts presented.
This capability will mature in the interaction in the classroom, with the teacher and with fellow students, in reading essays, articles, scientific papers.
4. Communication skills: the ability to communicate their knowledge in a clear and correct manner
Outcomes to be achieved by discussions in the classroom, interacting actively during lectures, workshops, seminars, asking and answering questions, and also through written contributions. This skill can be developed especially in the second part of the course, devoted to the theme of the current  legal and social change in the areas that relate to families.
5. Learning Skills: methods of analysis of the problems,  independent judgment. Skills to be acquired primarily discussing with other students and with the teacher the themes of the course. Knowledge of the  study materials will offer a greater capacity for further learning. The teacher in the course will encourage the acquisition of such skills, which will be evaluated during the exam

Supporting Activities

Through the Moodle platform  will be made available to students numerous materials, consisting both in texts and in significant pictures and photographs to allow them to put in context the social and legal changes that will be covered in the course.

Assessment

The assessment is done individually on the occasion of regular exams and is done by a committee chaired by the form teacher, by oral examination.

The purpose of this review is to assess the basic knowledge related to the current structure of the epistemological discipline, mastery of the issues that relate to the evolution of family law in its relations with social change, the ability to critically examine the normative changes and the evolution of the ordinary and constitutional jurisprudence in the context of Italian and European society. 

Students having regularly attended course lessons  will present a written essay on one of the topics covered in the course, which will be discussed during the examination and may contribute positivelyto the overall assessment if it proves that the studentes has acquired adequate knowledge of the topics and analytical skills 

The student can request to sit the final exam in English with an alternative bibliography in this language.
