Learning Objectives

The course aims to illustrate the fundamental institutes of sports justice. In particular, within the wider framework of the system of governing sport, in-depth sport justice procedures within CONI and the sports federations will be investigated. The completion of the justice due to the knowledge of the ordinary judge, in particular of the administrative judge, will also be represented. The course, therefore, will summarily recall the fundamental principles of the process, to give space to the forms of protection in sports regulations and, correlatively, to explain their operations and organization.
The student is led to learn the procedural structure of the sports justice system, the procedures for carrying out the proceedings within the internal bodies and the parallel forms of protection of the ordinary jurisdiction, with specific reference to the knowledge of the administrative judge.
The knowledge of the procedural rite will therefore necessarily be related to the subjective legal positions and special relationships that characterize the sporting activity, on the basis of an understanding of sporting law and the subjects that administer it, essential for a comprehensive approach to the object of justicial protection and jurisdictional.

The course will mainly cover the following topics:
The Italian and international sports system; The relationships between sports organization and state regulations; The subjects (C.O.N.I., Federations, affiliations); Sports fraud and doping; Disciplinary power; Technical rules and measures; The sports justice system; Sporting judges; Federal judges; The Prosecutor's office; The Sports Guarantee Committee; The reserve clause and the sports ruling; The jurisdiction of the ordinary judge in sports matters; Administrative jurisdiction in sports matters; Arbitration.

Learning Achievements (Dublin Descriptors)

The learning outcomes are articulated according to the following lines of verification:
- Knowledge and understanding: complete knowledge and understanding of the functioning and articulation of the sports justice system. The examination requires a capacity to connect the procedural rules aimed at demanding a dynamic knowledge of the individual institutions and of the process in general.
- Applying knowledge: in-depth knowledge of the forms of judicial and jurisdictional protection.
- Making judgments: integrating knowledge and managing complexities. The student is presented with innovative judgments of procedural practices and rites, stimulating research in specialized case magazines and in-depth topics during the lessons, using the Moodle platform (http://blended.uniurb.it).
- Communication skills: clarity and precision of communication skills.
- Learning skills: adequate development of learning skills. The student must demonstrate a dynamic assimilation of the rules of the sports code, grasping the connections and the interconnections of the individual institutes and the mechanics of carrying out the rites.

Assessment

Oral examination. The student must know how to display the procedures of the rite with precision, demonstrating a mastery of the language of the trial and an ability to reason the mechanisms that structure sporting justice. The oral form allows an immediate and adequate verification of these skills and acquired maturity.
The expected learning outcomes will be evaluated, as mentioned, through an oral exam based on at least three questions. The evaluation criteria and correlated scores are determined according to the following scale:
less than 18/30: insufficient level of competence. The candidate does not reach any of the learning outcomes foreseen at the point "knowledge and understanding skills";
18-20 / 30: level of sufficient competence. The candidate reaches, in particular, the learning outcomes foreseen at the point "knowledge and understanding skills";
21-23 / 30: level of competence fully sufficient. The candidate reaches, in particular, the learning outcomes foreseen at the points "knowledge and understanding skills" and "applied knowledge and understanding skills";
24-26 / 30: level of competence: good. The candidate reaches, in particular, the learning outcomes foreseen at the points "knowledge and understanding skills"; "Applied knowledge and understanding skills" and "independent judgment";
27-29 / 30: very good level of competence. The candidate reaches, in particular, the learning outcomes foreseen at the points "knowledge and understanding skills"; "Knowledge and understanding skills applied"; "Autonomy of judgment" and "communication skills";
30-30 cum laude: excellent level of competence. The candidate fully achieves the learning outcomes foreseen at the points "knowledge and understanding skills"; "Knowledge and understanding skills applied"; "Autonomy of judgment"; "Communication skills" and "ability to learn".
